Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TextPals platform and all AI coaching services available via SMS and at textpals.co (collectively, the "Service"). By signing up, texting in, or subscribing, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

TextPals is an AI coaching platform that connects users with specialized AI coaches via SMS and iMessage — no app download required. Coaches are available across a range of topics including (but not limited to) GLP-1 / weight-loss support, personal finance, astrology, pastoral companionship, medspa business coaching, and tech support. The lineup of available coaches may change over time.

Each coach is an AI assistant powered by large language models. They are designed to provide coaching, information, accountability, and companionship via text message. They are not licensed medical professionals, therapists, lawyers, financial advisors, or clergy.

2. Not Medical, Legal, or Professional Advice

Nothing the Service provides constitutes medical advice, diagnosis, treatment, or a doctor-patient relationship. Marc Tot is not a doctor. For anything related to your medication, dosing, side effects, or symptoms, contact your prescriber or a licensed healthcare provider. In a medical emergency, call 911.

Similarly, no content from the Service constitutes legal advice, financial advice, tax advice, investment advice, or religious/sacramental services. Jake Whitman is not a licensed financial advisor or CPA. Bianca Moretti is not a lawyer or compliance officer. Father Michael cannot administer sacraments, including absolution. Luna Castellanos provides astrology for entertainment and self-reflection only.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms.

4. SMS Communications and TCPA Consent

By providing your mobile phone number and initiating contact with the Service, you expressly consent to receive recurring automated text messages (SMS/MMS) from TextPals, including coaching messages, check-ins, subscription confirmations, and service updates. Message frequency varies based on your usage and preferences.

To opt out of SMS messages at any time, reply STOP to any message. Reply HELP for help. You may also manage your preferences at /account or by emailing admin@rodeomoney.com.

5. Subscriptions, Billing, and Cancellation

Access to the Service requires a paid subscription. By subscribing, you authorize us to charge your payment method on a recurring basis (weekly, monthly, or as described at the time of purchase) until you cancel. Subscription fees are non-refundable except as required by applicable law or at our sole discretion.

You may cancel your subscription at any time by visiting /account or by contacting admin@rodeomoney.com. Cancellation takes effect at the end of your current billing period; you will retain access until that date. We reserve the right to modify subscription pricing with reasonable advance notice.

7. Intellectual Property

The Service, including its AI personas, branding, software, and content, is owned by TextPals and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial purposes. You retain ownership of content you send to the Service.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI RESPONSES WILL BE ACCURATE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEXTPALS' TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9. Indemnification

You agree to indemnify and hold harmless TextPals and its affiliates, employees, and contractors from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.

10. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding individual arbitration under the rules of the American Arbitration Association. You waive any right to participate in class-action lawsuits or class-wide arbitration. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms at this URL and updating the "Last updated" date. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
